Strangers have entered the humanitarian zones under the cover of night. A member of Justicia y Paz was kidnapped for 1.5 hours.1. SUMMARY OF RECENT EVENTS:
On Saturday, August 30th 2008, at 12:30 am, unidentified men entered the Humanitarian Zone of Camelias in Curvarado and made their way towards the home where human rights defenders LUZ MARINA ARROYABE, ANDREA ABELLO and CARLOS TORRES lay sleeping. When the inhabitants discovered the unidentified men, they fled, hiding among the trees of the illegal palm plantation. At 1 am, Colonel MORENO of the Armed Forces was informed of the facts, yet no observable action was taken to address the situation. The inhabitants of the zone circled the perimeter of the community as a manner of self-protection until the sun rose. Following this incident, two human rights defenders of the Commission of Justicia y Paz were forced to leave the region on Saturday. On Tuesday, September 2nd 2008 at 4:13 pm, a new death threat was received by telephone, the 4th threat in 10 days. The call was received on the personal cell phone of the human rights defender Elizabeth Gomez from the number 313-424-5139 saying, "Leave the zone, we will finish off your family, you bitch". Wednesday September 3rd, 2008 at 3 pm at the bus station in Chigorodo, the human rights defender and member of Justicia y Paz YIMMI ARMANDO JANSASOY MUNOZ was kidnapped by armed civilians in a paramilitary operation. He was forced into a Toyota Hillux truck, with a large cabin, grey colour with tinted windows. A few minutes before the kidnapping Yimmi was with Abilio Pena and Danilo Rueda of Justicia y Paz who had just left the station. One and a half hours later, he was released. During that time his captors threatened to kill him and his entire family if he refused to inform them about the families of other human rights defenders in the Humanitarian Zone of Andalucia, Cano Claro. These acts of intimidation seem to be the manifestation of the death threats from the "Black Eagles" (Aguilas Negras) in the preceding days. Until now, we had no knowledge of any concrete action taken that would serve to identify the location of the calls and the people that made them nor the intellectual authors of the threats and the subsequent actions. These recent events confirm the absence of safety to exercise human rights defence work. In the very moment when legal actions have provided a victory for the resistance communities and as far as giving the order to the URABA police to remove the companies that usurp the legitimate lands of the Community Councils of the Afro-descendants, these paramilitary-style actions have taken an amplitude bitterly reminiscent of the deaths and disappearances among the African-Colombian communities during the long battle for the respect of their human rights. Queremos poner en su conocimiento los siguientes hechos para que tomen medidas inmediatas. Miércoles 3 de septiembre a las 3:00 p.m. en el terminal de transporte de Chigorodó el defensor de derechos humanos de la Comisión de Justicia y Paz, YIMMI ARMANDO JANSASOY MUÑOZ fue raptado por civiles armados en una actuación de tipo paramilitar, quienes lo obligaron a subirse a una camioneta Toyota Hillux doble cabina de color gris con vidrios polarizados. Minutos antes de este hecho ABILIO PEÑA y DANILO RUEDA defensores de derechos humanos de la Comisión de Justicia y Paz, habían abandonado el terminal en el que se encontraban con YIMMI. Una hora y cuarto después fue dejado en libertad, luego de ser amenazado él y su familia de muerte de no entregar información sobre las direcciones y nombres de los familiares de los defensores de derechos humanos de la Comisión de Justicia y Paz, que se encontraban en la Zona Humanitaria de Andalucía Caño Claro. YIMMI fue tendido en el interior de la camioneta, sus pertenencias requisadas, fotografiado su rostro y su documento de identidad por ambas caras. Los 4 hombres que participaron en el operativo no se identificaron pero recibían instrucciones permanentes a través de una comunicación celular. Martes, 2 de septiembre a las 4:13 de la tarde, el equipo acompañante de Justicia y Paz en la cuenca del Curvaradó recibió por cuarta vez, en 10 días, una amenaza de muerte al teléfono móvil 3115499463 propiedad de la defensora de derechos humanos de Justicia y Paz ELIZABETH GOMEZ. Una mujer se comunicó desde el teléfono móvil 3134245139 diciendo: "salgan de la zona, vamos a acabar con su familia HP". La llamada se recibió en momentos en que se encontraban reunidos/as los/as defensores/as de derechos humanos: ELIZABETH GOMEZ, LUZ MARINA ARROYABE, YIMMI JANSASOY, FABIO ARIZA, SENAIDA PARRA, EDUARD MINA, DANILO RUEDA y ABILIO PEÑA. Acompañados/as por la observadora internacional del PASC de Canadá TANIA HALLE y de integrantes de Peace Brigades Internacional, PBI. Esta llamada se suma a las tres recibidas anteriormente los días 24 y 25 de agosto. El domingo 24 de agosto se recibieron dos llamadas y desde la primera, quien llamó identificándose como "Águilas Negras", exigió la salida inmediata de los/as 8 defensores/as de derechos humanos de la Comisión de Justicia y Paz que se encontraban en ese momento en la zona. En la llamada del lunes 25 de agosto amenazaron: "con militares o sin militares, los vamos a mata". A estas llamadas se suma también la entrada intimidatoria de dos hombres en la madrugada del sábado 30 de agosto a la Zona Humanitaria de Camelias en el Curvaradó. A raíz de estas amenazas se vieron obligados a salir de la zona una defensora y un defensor de derechos humanos de la comisión de Justicia y Paz. Por lo anterior les solicitamos de manera urgente, Francisco Santos: al Ministro del Interior, Fabio Valencia Cossio; al Ministro de Relaciones Exteriores, Al Vicepresidente FRANCISCO SANTOS: Adoptar medidas eficaces, concretas, medibles y evaluables tendientes a propiciar la restitución de la propiedad de la tierra colectiva ocupada de mala fe por empresarios beneficiarios del paramilitarismo. Adoptar medidas concretas frente a las operaciones de tipo paramilitar de las "Águilas Negras" en Barranquillita, Nuevo Oriente, Cerro El Cuchillo, Mutatá, Brisas de Curvaradó, Llano Rico, Belén de Bajirá, Finca No te Pases y Tierradentro. Desarrollar una estrategia integral preventiva que involucre al Ministerio de Ambiente, la intervención sobre las corporaciones ambientales Codechocó y CorpoUrabá a fin de evitar la ampliación de la siembra de palma, la extensión ganadera y la deforestación intensiva Dar cumplimiento a las Medidas Cautelares de los defensores y defensoras de derechos humanos de nuestra Comisión de Justicia y Paz, y garantizar el derecho a la asistencia humanitaria y la protección de organismos internacionales de observación Al Fiscal General de la Nación, MARIO IGUARAN ARANA : Tomar decisiones de fondo dentro del proceso 3856 a fin de posibilitar el acceso a la verdad, a la justicia y la protección del derecho a la tierra de los afrocolombianos Attentamente, YOUR NAME AND ORGANIZATION HERE
III. SOLICITATIONS
To the Vice-President FRANCISCO SANTOS: Adopt efficient, concrete, measurable and evaluable measures in order to permit the restitution of traditional, collectively-owned lands currently occupied in bad faith by plantation companies benefitting from paramilitarism. Adopt concrete measures to deal with the paramilitary style operations of the "Águilas Negras" in Barranquillita, Nuevo Oriente, Cerro El Cuchillo, Mutatá, Brisas de Curvaradó, Llano Rico, Belén de Bajirá. Develop an integral and preventive strategy involving the Minister of the Environment and the intervention of the environmental corporations of Codechocó and CorpoUrabá, in order to avoid the continuation of planting plam trees, the extension of livestock and intensive deforestation. Apply preventive measures for the human rights defenders of the Commission of Justicia y Paz, and guarantee the right of humanitarian assistance to the Commission of Justicia y Paz and the protection of international observation organizations.
